10.ASSIGNMENT: This agreement cannot be transferred or transferred to third parties without the written agreement of ALTITUDE. DENVER — According to Jim Martin, president and CEO of Kroenke Sports and Entertainment, he has signed a multi-year contract with DirecTV for Friday`s reboot, ending a two-month dispute with the distributor that prevented nuggets and Avalanche fans from watching their teams. The terms of the agreement were not disclosed. Altitude President Matt Hutchings issued a statement following the agreement, with the question: “What makes Denver Nuggets and Colorado Avalanche fans differently? Why did Comcast decide that Marquee Sports Network should be offered fair market-based conditions, but not altitude? 4.PERIPHERAL EQUIPMENT: All plug-in peripheral elements that include servers, switches, headsets, dialers, U.S. devices, telephone answering machines and wireless or wireless phones that are not provided by LABE are not covered by this agreement. StratusIQ has extended our agreement with the Altitude Sports network so that our customers can be sure that they can continue to observe their favorites such as 2.PAYMENT, EQUIPMENT and TERM: This agreement begins on the date accepted by ALTITUDE and applies for the period shown below. Client undertakes to pay ALTITUDE the following amounts and all other amounts attached to Schedule “A” of the Service Level Addenda (“SLA”) that are an integral part of this agreement, collectively referred to as “PAYMENT”. The news comes on the heels of a long season of negotiations between Altitude Sports, Comcast and DISH Network. The regional sports channel`s contract with Comcast and DISH Network expired in September and the various parties did not reach an agreement in renewal negotiations. 12.PERFORMANCE: Altitude assumes no guarantees regarding the equipment, which is either expressly stated, unless provided for in this agreement. All warranties are invalid or unusable in the event of an uninterrupted power outage (UPS), negligence, abuse, theft, vandalism, fire, water, God`s action or other hazards or by moving, repairing, moving or modifying that have not been authorized by Altitude.
Altitude is in no way responsible for special, accidental or consequential damage for losses, damages or costs resulting directly or indirectly from the customer`s inability to use the device either separately, in combination with other devices, or for any other cause. The customer gives Altitude full and unlimited access to the premises where the system is installed for maintenance purposes. 11.SUPPLEMENTARY SERVICES: If new or additional services are added to ALS after the date of this agreement, these supplements increase the cost of the program at the current price offered by the altitude.
